Terms of Service

Welcome to ImGui.Design ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our services and products ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Definitions

1.1 "Services" refers to the creation, customization, and delivery of ImGui designs, whether premade or custom, as well as any related communication or support provided by us.

1.2 "Completion of Work" refers to the point at which the final design files are delivered to the customer, regardless of whether the customer has provided final approval.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

3. Orders and Payment

• 3.1 Placing Orders: Orders for our products and services are conducted through direct messages on Discord with the developer. All orders are subject to acceptance by the Company.
• 3.2 Payment: Payment for products and services must be made in full at the time of order unless otherwise agreed upon in writing. We accept various payment methods, including cryptocurrency. By placing an order, you acknowledge and agree that cryptocurrency payments are non-refundable.
• 3.3 Cryptocurrency Payments: Payments made in cryptocurrency are non-refundable due to market fluctuations and wallet restrictions. All sales are final, and refunds are not allowed under any circumstances.
• 3.4 Custom Orders: For custom design orders, customers must provide a detailed outline of the work required during the Discord conversation with the developer. The Company will provide a quote based on this outline, and work will commence upon receipt of payment.
• 3.5 Cancellation by the Developer: Projects may be canceled at the discretion of the developer at any time. In the event of such a cancellation, any incomplete work may be retained by the Company, and no refunds will be issued.

4. Delivery

• 4.1 Premade Designs: Premade designs will be delivered electronically via Discord or email as soon as payment is confirmed.
• 4.2 Custom Designs: Custom designs will be delivered according to the agreed-upon timeline discussed during the Discord communication. We strive to meet deadlines but are not liable for any delays caused by unforeseen circumstances.
• 4.3 Delivery Acceptance: Once the design files are delivered, the customer has 7 days to review and request minor adjustments. If no communication is received within this period, the work will be considered accepted and complete.

5. Intellectual Property

• 5.1 Ownership: All designs, whether premade or custom, remain the intellectual property of ImGui.Design until full payment is received.
• 5.2 License: Upon full payment, customers receive a non-exclusive, non-transferable license to use the purchased designs for their intended purpose. Customers may not resell, redistribute, create derivative works, or otherwise exploit the designs without our express written consent.

6. Refunds and Cancellations

• 6.1 Premade Designs: Refunds are not available for premade designs due to their digital nature.
• 6.2 Custom Designs: Cancellations of custom design orders may be requested prior to the commencement of work. If work has already begun, refunds may be issued at our discretion, less any work completed and resources spent.
• 6.3 Project Cancellation: Violation of any of these Terms, including but not limited to disrespectful communication, failure to provide necessary materials, or breach of confidentiality, may result in the immediate cancellation of the project. In such cases, any incomplete work will remain the property of ImGui.Design, and no refunds will be issued.

7. Confidentiality

All communications between the project owner and the ImGui.Design developer are confidential. Neither party shall disclose any confidential information, discussions, or details of the project to any third party without prior written consent from the other party.

8. Customer Conduct

We expect all customers to communicate respectfully and professionally. Blatant disrespect, abusive language, or unprofessional conduct towards the developer or company may result in the immediate cancellation of services, including any incomplete projects, without a refund. By engaging our Services or contacting the developer, you agree that in cases of misconduct, you forfeit any right to a refund.

9. Customer Reviews

By submitting a review, you grant ImGui.Design the right to use, modify, and display the review on our website and in other marketing materials.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that our Services will be error-free, uninterrupted, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, ImGui.Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, even if we have been advised of the possibility of such damages. In any event, our total liability to you for any claims arising out of or related to these Terms or the Services will not exceed the amount you paid us for the Services.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the country in which ImGui.Design is based. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that country.

13. Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve any disputes with ImGui.Design through good-faith negotiation or, if necessary, through mediation or arbitration.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.

15. Acceptance of Terms

By placing an order, making a payment, or contacting the developer, you acknowledge that you have read, understood, and agree to these Terms, including the non-refundable nature of payments and the conditions under which services may be canceled.
